By creating an account or accessing OpenForum.social, you agree to be bound by these Terms of Service. If you do not agree to these terms in their entirety, you may not use the platform. These terms constitute a binding legal agreement between you and OpenForum, LLC, a Wyoming limited liability company.
OpenForum.social is a user-generated content platform designed to facilitate open, uncensored communication among its users. The platform is funded exclusively by user micro-transactions. We do not display advertising. We do not sell user data. We do not exercise editorial control over lawful user expression.
You acknowledge that the platform is designed to host a wide range of viewpoints, including viewpoints that may be offensive, controversial, politically extreme, or personally disagreeable to you. Exposure to such viewpoints is an inherent and intended characteristic of the platform. Your decision to use OpenForum constitutes your acknowledgment and acceptance of this.
You are solely responsible for all content you post, share, or transmit on OpenForum. You represent and warrant that you have all rights necessary to post your content and that your content does not violate applicable law.
The following categories of content are prohibited and subject to removal:
All other content, regardless of its political content, offensiveness, or controversial nature, is protected on this platform and will not be removed. This list is exhaustive and closed. No additional categories of prohibited content exist.
When you submit a request to create a community group, the group name, description, and proposed category are evaluated by an artificial intelligence system (Claude) against the platform's existing hierarchical group taxonomy. This evaluation determines whether the proposed group is novel, similar to an existing group, or duplicative. Group names that incorporate the name of a recognized major political party are rejected; substantive policy or ideological descriptors are required instead. This evaluation is a structural platform function, not content moderation, and does not affect any content you post.
OPENFORUM.SOCIAL LLC, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES ARE NOT LIABLE FOR ANY CONTENT POSTED BY USERS. WE ARE NOT LIABLE FOR ANY HARM, INJURY, DAMAGE, OR LOSS OF ANY KIND ARISING FROM YOUR USE OF THE PLATFORM OR YOUR EXPOSURE TO CONTENT POSTED BY OTHER USERS.
The platform is provided AS IS and AS AVAILABLE without warranty of any kind, express or implied. We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components.
YOU USE THIS PLATFORM ENTIRELY AT YOUR OWN RISK. If you are harassed, offended, or harmed by another user, your remedy is to block that user, report content that falls within our three prohibited categories, or cease using the platform. We are not responsible for the acts or omissions of other users.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OPENFORUM.SOCIAL LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, EMOTIONAL DISTRESS, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising from or related to these terms or your use of the platform shall not exceed the amount you paid to OpenForum.social in the twelve months preceding the claim.
You retain all rights to the content you post. By posting content, you grant OpenForum.social a non-exclusive, royalty-free license to display, transmit, and distribute your content solely for the purpose of operating the platform. We claim no ownership of user-generated content.
The OpenForum.social platform, interface, and technology are proprietary to OpenForum, LLC and protected by applicable intellectual property law, including one or more pending U.S. patent applications.
You may deactivate your account at any time through Settings. We may suspend or terminate accounts that post content within the three prohibited categories or that engage in activity that violates applicable law. We will not terminate accounts solely because of the political content, offensiveness, or controversial nature of lawful speech.
These terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles. Any dispute arising from these terms or your use of the platform shall be resolved exclusively in the state or federal courts located in Wyoming. You consent to the personal jurisdiction of such courts.
OpenForum operates a closed-set content policy. The three rules listed in Section 3 are the only categories of content subject to removal. This list is exhaustive, immutable, and enforced exclusively by AI review. No human moderator removes lawful speech.
OpenForum does not remove, suppress, throttle, downrank, shadow-ban, or deprioritize any content outside its three published content rules, regardless of the source of the request. This applies to requests from governments, law enforcement, institutions, advertisers, and private parties.
OpenForum serves user data only under a qualified warrant issued by a court with jurisdiction over Wyoming, the state of incorporation. Bulk surveillance requests, fishing expeditions, and political pressure disguised as law enforcement are refused.
Executive trust and safety staff and Claude may access your account at OpenForum only under credible threats of violence or unlawful activity and only when accompanied by a valid request from a verified law enforcement official.
OpenForum treats the First Amendment of the United States Constitution as a fundamental human right. OpenForum does not comply with speech restrictions from jurisdictions whose laws do not comport with First Amendment principles, except within that jurisdiction's own territorial reach.
We may update these terms from time to time. We will provide notice of material changes through the platform. Your continued use of the platform after notice constitutes acceptance of the updated terms.
